1. Scope of This Policy
This Cancellation & Refund Policy applies to all bookings made through Diventures Club, operated by Diventures Magazine LTD (United Kingdom).
By making a booking on the Platform, the customer confirms acceptance of this Policy, which forms an integral part of the Terms & Conditions.
Diventures Club operates as an online marketplace and payment intermediary and does not provide diving services directly.
2. Definitions
For the purpose of this Policy, the following definitions apply:
- Service Start Date: The first scheduled day of the diving trip or diving course
- Platform Fee: Diventures Club commission and payment processing fees (non-refundable)
- Provider Share: The portion of the booking amount payable to the service provider
- Customer Arrival: The physical arrival of the customer at the provider’s location
- Course Materials & Registration Fees: Costs related to digital learning materials, manuals, certification processing, and registration with a recognized diving organization (e.g. PADI, SSI, SDI), once issued or activated
3. Customer-Initiated Cancellations (General Services)
3.1 Cancellation More Than 7 Days Before Service Start
Refund Amount:
- ✅ 75% refund to the customer
- ❌ 25% non-refundable
3.2 Cancellation Between 3 and 7 Days Before Service Start
Refund Amount:
- ✅ 50% refund to the customer
- ❌ 50% non-refundable
3.3 Cancellation Less Than 72 Hours Before Service Start
Refund Amount:
- ❌ No refund
3.4 No-Show by Customer
Refund Amount:
- ❌ No refund
Failure to attend without prior cancellation is treated as full forfeiture of the booking.
4. Special Conditions for Diving Courses
(Very Important)
4.1 Course Materials & Training Organization Registration
For diving courses, once course materials or training organization registration have been issued or activated:
- The cost of course materials and registration fees is non-refundable
- This applies regardless of the cancellation reason or timing
These costs may include:
- Digital learning materials
- Online theory access
- Student registration with a diving organization
- Certification processing fees
4.2 Course Cancellation by Customer (At Any Time)
If a customer cancels a diving course for any reason or at any time, the refund will be calculated as follows:
Refund Amount:
- Refund = Total booking amount
minus- Platform Fee (non-refundable)
- Course materials & registration fees (non-refundable)
- Any delivered or partially completed training
4.3 Use of Course Materials After Cancellation
If course materials or registration have already been issued:
- The customer retains access to online materials
- The customer may use the materials or registration later, subject to:
- The rules of the selected diving organization
- The policies of the issuing provider or training agency
Diventures Club does not control the validity period or reuse conditions of training agency materials.
5. Provider-Initiated Cancellations
5.1 Provider Cancels Before Service Start
Customer may choose:
- ✅ 100% refund, or
- ✅ Rebooking with an alternative provider in the same area at no additional platform fee
5.2 Provider Cancels After Customer Arrival
Refund Amount:
- ✅ Pro-rated refund for undelivered services only
- ❌ No refund for services already delivered
Diventures Club may withhold or adjust provider payouts accordingly.
6. Provider Replacement or Referral
If a provider:
- Declines a booking
- Cancels a confirmed service
- Becomes unavailable
- Closes operations
Diventures Club may propose a replacement provider.
If the customer accepts the replacement:
- Booking continues
- No refund issued
If the customer declines the replacement:
- ✅ 100% refund, minus non-recoverable processing fees (if applicable)
7. Partial Service Completion
7.1 Diving Trips
- Refunds apply only to unused dive days
- Completed dives are non-refundable
7.2 Diving Courses
- Refunds apply only to undelivered course days
- Course materials, registration, and completed training are non-refundable
8. Dispute-Based Refunds
8.1 Dispute Window (Strict)
- Diving trips: within 5 days from the first dive day
- Diving courses: within 5 days from the first course day
8.2 Valid Dispute Grounds
- Service not delivered
- Provider no-show
- Serious misrepresentation
- Verified safety violations
Refund Amount:
- Up to 100%, depending on investigation outcome
Provider payouts may be withheld during dispute resolution.
9. Force Majeure Events
Examples include:
- Severe weather
- Government or port authority restrictions
- Natural disasters
- Sea or port closures
Refund Policy:
- ❌ No guaranteed refund
Possible outcomes (case by case):
- Partial refund
- Credit
- Rebooking
10. Payment Processing & Currency
- All payments and refunds are processed in USD
- Currency exchange differences are non-refundable
- Stripe processing fees are non-refundable
11. Abuse & Chargebacks
If a customer:
- Files a chargeback without contacting support, or
- Repeatedly abuses refund requests
Diventures Club may:
- Deny refunds
- Suspend or terminate the account
