1. Introduction
These Terms and Conditions (“Terms”) govern the use of the Diventures Club website and platform (“Platform”).
Diventures Club is operated by Diventures Magazine LTD, a company registered in the United Kingdom (“Diventures Club”, “we”, “us”, or “our”).
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Platform.
2. Platform Role and Scope
Diventures Club operates as an online marketplace and intermediary that connects customers with independent third-party service providers, including:
- Dive Centers
- Freelance Scuba Instructors
- Freelance Technical Instructors
- Freelance Divemasters (Dive Guides)
- Commercial Diving Schools
Diventures Club does not provide diving services, training, instruction, equipment, supervision, or operational control over any diving activity.
All services listed on the Platform are provided solely by independent third-party providers.
3. Independent Service Providers
All service providers listed on Diventures Club are independent contractors and are not employees, partners, agents, or representatives of Diventures Club.
Each provider is solely responsible for:
- Delivery of the service
- Safety standards and procedures
- Equipment and maintenance
- Staff qualifications and certifications
- Insurance coverage
- Compliance with local laws and regulations
Diventures Club does not supervise or control how providers perform their services.
4. Eligibility and User Responsibilities
By using the Platform, you confirm that:
- You are at least 18 years old
- You are legally capable of entering into binding agreements
- You meet all certification, medical, and fitness requirements required for the booked activity
You are responsible for ensuring that your health condition, training level, and certification are appropriate for the selected service.
5. Bookings and Service Requests
All bookings made through Diventures Club are booking requests.
A booking is considered confirmed only after the selected service provider accepts the request.
If a provider declines, becomes unavailable, or ceases operations, Diventures Club may:
- Offer an alternative provider in the same area, subject to your confirmation, or
- Process a refund in accordance with the Cancellation & Refund Policy
Diventures Club does not guarantee the availability of any specific provider.
6. Payments and Currency
All payments are processed online through Stripe.
- Customers are required to pay 100% of the service price at the time of booking
- Payments are processed in USD
- Any displayed currency conversion is provided for reference only
Diventures Club acts as a payment intermediary, temporarily holding funds before releasing payouts to service providers.
7. Provider Replacement and Referral
If a service provider:
- Cancels a booking
- Becomes unavailable
- Closes operations
- Fails to deliver the agreed service
Diventures Club reserves the right to propose an alternative provider in the same area and category.
No replacement will be made without the customer’s confirmation.
If no suitable alternative is accepted, a refund may be issued in accordance with the Cancellation & Refund Policy.
8. Disputes and Complaints
Any dispute or complaint related to a service must be submitted within the following timeframes:
- Diving trips: within 5 days from the first day of the trip
- Diving courses: within 5 days from the first day of the course
Disputes submitted outside these periods may not be considered.
Diventures Club may temporarily withhold provider payouts during dispute investigation.
9. Diving Risks and Assumption of Risk
Scuba diving and related activities involve inherent risks, including serious injury or death.
By booking through Diventures Club, you acknowledge and accept that:
- Participation is at your own risk
- Diventures Club does not provide medical, training, or safety advice
- You are responsible for complying with all certification and medical requirements
10. Limitation of Liability
To the maximum extent permitted by law:
- Diventures Club shall not be liable for any injury, loss, damage, delay, or expense arising from services provided by third-party providers
- Diventures Club shall not be liable for accidents, equipment failure, weather conditions, or provider misconduct
Diventures Club’s liability, if any, is strictly limited to the platform service fees paid by the customer.
11. Cancellations and Refunds
Cancellations and refunds are governed exclusively by the Cancellation & Refund Policy, which forms an integral part of these Terms.
12. Suspension and Termination
Diventures Club reserves the right to suspend or terminate access to the Platform if a user:
- Violates these Terms
- Engages in fraudulent or abusive behavior
- Misuses the Platform
Termination does not affect rights or obligations accrued prior to termination.
13. Intellectual Property
All content, branding, text, graphics, and platform features are the property of Diventures Club or its licensors.
Unauthorized reproduction or use is prohibited.
14. Amendments
Diventures Club may update these Terms at any time.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Kingdom.
Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
